1 Agreement to Terms

By accessing the Biznex Realestate website (info@biznex.live), using our mobile application, visiting our office at Shop No. 12, Adajan Business Center, Adajan, Surat, Gujarat 395009, or engaging our real estate advisory services in any manner, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our website, services, or interact with our platform in any capacity.

These Terms constitute a legally binding agreement between you ("User," "Client," or "You") and Biznex Realestate ("Company," "We," "Us," or "Our"). We reserve the right to modify, amend, or update these Terms at any time without prior notice. Continued use of our services after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.

2 Services Description

Biznex Realestate provides comprehensive real estate advisory and facilitation services including but not limited to:

  • Property search, identification, and shortlisting based on client requirements, budget, and preferences across residential, commercial, and land categories.
  • Arranging property site visits, virtual tours, and physical inspections with property developers, sellers, or landlords.
  • Facilitating negotiations between buyers and sellers, tenants and landlords, to achieve mutually beneficial transaction terms.
  • Legal documentation assistance including sale deed drafting, agreement preparation, title verification, and RERA compliance checks.
  • Investment advisory services providing market analysis, ROI projections, and risk assessment for property investment decisions.
  • Rental property management including tenant sourcing, rent collection, maintenance coordination, and periodic inspections.
  • Interior design coordination, home loan assistance, insurance facilitation, and post-purchase support services.

Biznex Realestate acts as an intermediary and facilitator. We are not the owner, developer, or seller of any property listed on our platform unless explicitly stated. All property transactions are directly between the buyer/seller or tenant/landlord, with Biznex facilitating the process.

3 User Obligations

By using our services, you agree to the following obligations:

  • Provide accurate, complete, and up-to-date personal information including name, contact details, PAN/Aadhaar (for verification), and financial capacity information.
  • Not misrepresent your identity, financial capacity, or intention regarding any property inquiry or transaction.
  • Not use our platform for any fraudulent, illegal, or unauthorized activities including but not limited to money laundering, benami transactions, or document forgery.
  • Not attempt to bypass, disable, or interfere with security features, access controls, or usage monitoring systems on our website or application.
  • Not copy, reproduce, distribute, or create derivative works from any content, property listings, images, or data available on our platform without written permission.
  • Not solicit, contact, or negotiate directly with property owners/developers introduced through Biznex without our knowledge, bypassing our facilitation services.
  • Keep your account credentials confidential and notify us immediately of any unauthorized access or security breach.
  • Comply with all applicable laws, regulations, and guidelines including RERA Act, GST provisions, Income Tax Act, and property registration laws of India.

4 Fees and Payment Terms

Our service fee structure is as follows and is subject to change with prior notice:

  • Property Purchase Facilitation: Service charges of 1% to 2% of the property transaction value or a fixed fee as agreed upon in writing before the transaction.
  • Rental Property Facilitation: One month's rent or a fixed percentage as mutually agreed, payable upon successful tenant placement.
  • Legal Documentation: Separate charges for legal services as per the scope of work, communicated upfront before commencement.
  • Investment Advisory: Advisory fees as per the engagement letter, which may be fixed, hourly, or percentage-based depending on the scope.
  • Property Management: Monthly management fees as a percentage of rent collected, typically 8% to 10% as agreed in the management contract.

All fees are exclusive of applicable GST and government levies. Payment is due within the timeline specified in the service agreement. Late payments may attract interest at 18% per annum. Biznex Realestate reserves the right to suspend or terminate services for clients with outstanding payments beyond 30 days from the due date.

5 Property Information Disclaimer

While we make every effort to ensure the accuracy and completeness of property information displayed on our platform, including pricing, specifications, amenities, images, location details, and legal status, Biznex Realestate does not guarantee the absolute accuracy of any such information. Property details are provided by developers, sellers, and landlords and are subject to verification.

Users are strongly advised to:

  • Conduct independent verification of all property details including area measurements, legal titles, approvals, and encumbrances.
  • Visit the property personally or through authorized representatives before making any purchase or rental decision.
  • Engage independent legal counsel for title verification and due diligence before executing any property transaction documents.
  • Verify RERA registration status, completion certificates, occupancy certificates, and other regulatory compliances independently.

Biznex Realestate shall not be held liable for any discrepancy between listed property information and actual property conditions, or for any loss arising from reliance on information provided on our platform without independent verification.

6 Notification and Communication Consent

7 Intellectual Property

All content on the Biznex Realestate website and platform, including but not limited to text, graphics, logos, icons, images, photographs, videos, property listings, market data, software, code, and the overall design and layout, is the exclusive intellectual property of Biznex Realestate or its content suppliers and is protected by Indian and international copyright, trademark, and intellectual property laws.

Unauthorized use, reproduction, modification, distribution, or display of any content from our platform is strictly prohibited and may result in legal action. The Biznex Realestate name, logo, and all related marks are registered trademarks and may not be used without prior written consent.

8 Limitation of Liability

To the maximum extent permitted by applicable law, Biznex Realestate, its directors, employees, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from or related to:

  • Any inaccuracy in property information, pricing, or specifications listed on our platform.
  • Any delay, failure, or interruption in our services due to technical issues, force majeure events, or third-party actions.
  • Any financial loss arising from property transactions facilitated through our services.
  • Any dispute between property buyers and sellers, tenants and landlords, or any other parties involved in a transaction.
  • Any unauthorized access to your personal information despite our reasonable security measures.
  • Any decisions made based on information, advice, or recommendations provided through our platform.

Our total cumulative liability for any claims arising from or related to our services shall not exceed the total service fees paid by you to Biznex Realestate in the twelve (12) months preceding the claim.

9 Indemnification

You agree to indemnify, defend, and hold harmless Biznex Realestate, its directors, officers, employees, agents, successors, and assigns from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your use of our services, your violation of any applicable law or regulation, or any actions or omissions by you that cause harm to Biznex Realestate or any third party.

10 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the services provided by Biznex Realestate shall be resolved through the following mechanism:

  • Informal Resolution: Both parties shall first attempt to resolve the dispute through good-faith negotiation within 30 days of the dispute arising.
  • Mediation: If informal resolution fails, the dispute shall be referred to a mutually agreed mediator in Surat, Gujarat.
  • Arbitration: If mediation fails within 60 days, the dispute shall be referred to arbitration as per the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Surat, Gujarat, in English language, and the arbitral award shall be final and binding.
  • Jurisdiction: Subject to the arbitration clause, the courts of Surat, Gujarat shall have exclusive jurisdiction over any legal proceedings arising from these Terms.

11 Termination

Biznex Realestate reserves the right to terminate or suspend your access to our services at any time, without prior notice, for any reason including but not limited to breach of these Terms, fraudulent activities, abusive behavior, or non-payment of service fees. Upon termination, your right to use our services shall immediately cease.

You may terminate your engagement with our services by providing written notice to info@biznex.live. Termination will not affect any obligations or liabilities that arose prior to the termination date, including payment obligations for services already rendered.

12 Force Majeure

Biznex Realestate shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, civil unrest, strikes, power failures, internet outages, or any other force majeure event. In such cases, we will make reasonable efforts to resume services as soon as practicable.

13 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. All rights and obligations under these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India, except as provided in the Dispute Resolution clause above.

14 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
